Cultivation, distribution, and intent to distribute marijuana all have different penalties for possession. If you’re caught, you could face time in prison.

Possession for Personal Use

Marijuana possession in Maryland is legal. However, certain laws must be followed in order to be in compliance with the laws of the state. For once, it is punishable to use it in public use, so make sure to consider dispensaries like Trulieve.

Possession of marijuana for personal use is limited to 10 grams. Any amount over 10 grams is considered a criminal offense. A person found guilty may have a one-year jail sentence or a fine of up to $1,000.

Possession With Intent to Distribute

Possession with intent to distribute is a serious charge in Maryland. There are several levels of seriousness to this charge, depending on the amount of marijuana that is found.

Generally, possession of marijuana with intent to distribute is a misdemeanor that is punishable by up to four years in prison and a fine of up to $25,000. If the amount of marijuana possessed is 10 pounds or more, it is a felony punishable by up to 20 years in prison.

Trafficking

Marijuana trafficking laws in Maryland are complex. They vary depending on the substance being trafficked, the quantity, and the accused’s prior convictions.

Generally, it is illegal to transfer, transport, or deliver more than 10 pounds of marijuana or any combination of marijuana and a mixture or substance containing marijuana in Maryland.

Penalties become more severe when marijuana is more than 50 pounds, with a maximum prison sentence of 40 years and a maximum fine of $1 million.

Cultivation

Marijuana Cultivation in Maryland is illegal, except for medical use, and carries heavy penalties. It is illegal to cultivate any type of marijuana, which includes plants, seeds, or any product derived from the plants.

Any person who is found guilty of marijuana cultivation in Maryland can be subject to imprisonment for up to five years and face a maximum fine of up to $15,000.

Hash & Concentrates

Maryland marijuana laws relating to Hash and Concentrates primarily focus on possession and consumption. Maryland prohibits the possession and consumption of hash and concentrates without a medical marijuana card.

Possession of hash or concentrates is a misdemeanor penalty and can carry up to a one (1) year sentence in prison and a maximum fine of $1,000. 

Paraphernalia

Maryland’s laws on marijuana paraphernalia aim to reduce the use of prohibited drugs and limit the adverse effects that illegal drug use can have on society. All paraphernalia used for the smoking and consumption of marijuana is illegal in the state, and selling, manufacturing, and possessing paraphernalia carries a penalty of up to one year in jail and a fine of up to $1,000.

Examples of paraphernalia include bongs, pipes, grinders, and rolling papers. It is important to note that although marijuana is decriminalized in Maryland, paraphernalia remains illegal.
