A mother jailed for 48 years for beating her 10 year-old daughter to death has demanded a new trial after claiming she was also a victim. Sharon Kennedy, 35, claims the judge who sentenced her for the February 2018 murder of her daughter Marissa in Belfast, Maine did so unfairly.
Kennedy says more consideration should have been given to the domestic abuse she suffered at the hands of boyfriend and accomplice Julio Carillo. The killer mom also says original trial judge Justice Robert Murray should have made allowances for her low IQ and intellectual disability.
Kennedy blamed both for her behavior, and says they made her more vulnerable to manipulation by Carillo. Lawyers for Kennedy claim she may have been acting under duress when she beat Marissa, and let Carillo abuse her daughter. They added that a 25 year prison sentence would have been sufficient punishment.
Their argument says: ‘Lay witnesses including medical providers, Sharon’s family and neighbors testified about Sharon’s fear of Julio and inability to form and express her own thoughts, opinion, or desires in the presence of Julio.

‘The (judge’s) attempt to divorce these facts from the events leading to Marissa’s death reveal a misunderstanding of the nature of domestic violence.’
Further hearings on whether to grant Kennedy a retrial will take place next week, the Bangor Daily News reported.
Marissa’s ordeal began when her mother married Carillo in 2015, with her stepdad beating her without reason, and throwing her teddy bear in a dumpster. Neighbors reported hearing the little girl scream, and the sound of her being slapped while begging Carillo to stop.
Kennedy is said to have joined in the beatings after accusing her daughter of faking injuries Carillo had inflicted, which left Marissa slurring and unable to walk properly.
The youngster eventually died of a heart attack because of the stress, wounds, injuries and infections triggered by her mother and stepfather’s torture.
Kennedy, who was jailed in February, has since annulled her marriage to Carillo. He was jailed for 55 years in July 2019 after admitting Marissa’s murder.
