Former President Donald Trump has appealed a judge’s civil contempt order hitting him with a $10,000 daily fine for not complying with a subpoena in a New York investigation into his company.
Trump filed his appeal a day after the fine went into effect on Tuesday. New York State Judge Arthur Engoron had issued a written order affirming his contempt finding and imposing the fine.
New York Attorney General Letitia James’ office has been investigating whether the Trump Organization provided fraudulent information to tax officials, borrowers and lenders.
The office requested that Engoron hold Trump in contempt for failing to comply with a subpoena issued in December. Trump’s lawyer Alina Habba stated that they searched and came up with no documents to provide to the investigation, apart from the 10 that the Trump Organization has already handed over.
Trump may not be responsible for paying the daily fine until the appeal is resolved.
Engoron in a written order on Tuesday stated that Trump ‘willfully disobeyed’ the subpoena order to provide documents and that his action harmed James’ civil investigation.
‘Thus, Donald J Trump is in contempt of Court and must pay a fine of $10,000 per day, from the date of this Decision and Order, until he purges such contempt to the satisfaction of this Court,’ Engoron wrote.
The judge added that ‘each day that passes without compliance further prejudices OAG, as the statutes of limitations continue to run and may result in OAG being unable to pursue certain causes of action that it otherwise would’.
James criticized Trump’s appeal.
‘The judge’s order was clear: Donald J Trump is in contempt of court and must pay $10,000 a day until he complies with our subpoenas,’ James stated. ‘We’ve seen this playbook before, and it has never stopped our investigation of Mr Trump and his organization. This time is no different.’
